Terms of Service

These Terms of Service ("Terms") are an agreement between you and AUTOFRAIME ("AUTOFRAIME," "we," "us") and govern your use of the AUTOFRAIME iPhone app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your account secure, for the accuracy of the information you provide, and for all activity under your account. Tell us promptly at autofraime@gmail.com if you believe your account has been compromised.

2. The Service

AUTOFRAIME lets you capture listing photos with your iPhone, straighten them, enhance them with artificial intelligence, create twilight versions, build flyers, and share or export the results. Features may change, and we may add, modify or remove features at any time.

3. Tokens

Certain features use tokens. Current costs are: enhancing a photo, 100 tokens; remaking a photo, 50 tokens the first time and 100 after; twilight, 50 tokens; exporting a flyer, 25 tokens. Costs are shown in the app before you spend and may change with notice.
New accounts receive a one-time grant of free tokens.
Tokens bought as token packs do not expire. Subscription tokens are described in section 4.
If an AI request fails to return a result, the tokens it used are returned to your balance automatically.
Tokens are a license to use features of the Service. They have no cash value, cannot be sold, transferred or exchanged for money, and are not refundable except as required by law or as provided by Apple.
We may correct balances that are wrong because of an error, and remove tokens obtained through fraud, abuse or a technical fault.

4. Subscriptions and purchases

Subscription plans (Starter, Pro and Studio) provide a monthly allowance of tokens and are billed through your Apple ID at confirmation of purchase.
Subscriptions renew automatically each month at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
You can manage or cancel a subscription at any time in your device's Settings, under your name, then Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you have paid for.
Unused subscription tokens roll over to the next month, up to a maximum of three months' worth of your plan's allowance, while your subscription stays active. Rolled-over subscription tokens are forfeited if your subscription ends.
All purchases are processed by Apple and subject to Apple's terms. Refund requests are handled by Apple at reportaproblem.apple.com. Except where required by law, we do not provide refunds or credits for partial periods or unused tokens.
Prices are listed in the app and may vary by region. If a subscription price increases, we or Apple will notify you in advance as required.
Deleting your account does not cancel an active subscription. Cancel it through Apple first.

5. AI-edited photos and your responsibilities

Enhanced and twilight photos are created by artificial intelligence. They are designed to improve light, color and clarity and, if you choose, remove clutter, while keeping the property as it is. AI can still make mistakes, including adding, removing or altering details.

You are responsible for every photo you publish. Before using any photo, you must review it and make sure it honestly and accurately represents the property. You must follow all laws, MLS rules, brokerage policies and advertising standards that apply to you, including any requirement to disclose that a photo has been digitally edited, enhanced, virtually staged or converted to twilight.

Results are provided as is. We do not guarantee that any result will be accurate, error-free, suitable for a particular listing, or accepted by any MLS or platform. Each photo you process is sent to third-party AI providers, as described in our Privacy Policy.

6. Your content

You keep ownership of the photos you capture or import, the results we produce from them, and the listing details you enter ("Your Content").
You grant AUTOFRAIME a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display Your Content only as needed to operate and provide the Service to you, including sending photos to our AI providers. This license ends when you delete the content or your account, except for copies you have shared with others.
You confirm that you own or have permission to use everything you upload, including photos of properties and any logos, and that you have any consent needed from property owners or occupants.
Client gallery links can be viewed by anyone who has the link. Share them only with people you intend to see them.
We do not use Your Content to train AI models and do not claim ownership of it.

7. Acceptable use

You agree not to:

use the Service for anything illegal, fraudulent or deceptive, including misrepresenting a property;
upload content you do not have the right to use, or that is obscene, hateful, harassing, or infringes anyone's rights;
upload images of people in ways that violate their privacy;
reverse engineer, decompile or copy the app, or try to bypass token charges, security or usage limits;
access the Service with bots or automated tools, or interfere with its operation;
resell or provide the Service to others as your own.

8. Beta features

Some features, including pre-release builds distributed through Apple TestFlight, are provided for testing. They may be incomplete, change or stop working, and may lose data. Purchases made in TestFlight builds use Apple's test environment and are not charged. Feedback you send us may be used to improve the Service without any obligation to you.

9. Termination

You may stop using the Service and delete your account at any time from the app (Account, then Delete account). We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination, including ownership, disclaimers, limitation of liability and governing law, survive.

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOFRAIME WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST COMMISSIONS, LOST DATA OR LOSS OF BUSINESS, ARISING FROM YOUR USE OF THE SERVICE OR ANY PHOTO IT PRODUCES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50 IF GREATER. Some jurisdictions do not allow these limits, so they may not apply to you.

11. Indemnity

You agree to defend and indemnify AUTOFRAIME against claims, losses and expenses, including reasonable legal fees, arising from Your Content, your listings or advertising, or your violation of these Terms or any law.

12. Apple App Store terms

These Terms are between you and AUTOFRAIME, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; to the extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims, or for investigating or defending any claim that the app infringes a third party's intellectual property. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with Apple's Standard End User License Agreement and the App Store Terms of Service.

13. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction, except where the law of your place of residence requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms here with a new effective date and, for material changes, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept them.
